Acceptance of terms

The Natureandpoverty.net platform ("Platform") is operated by IUCN National Committee of the Netherlands ("IUCN NL"). By accessing and using the Platform, you accept, and agree to be bound by the terms of service described on this page. You represent that you are of legal age to form a binding contract, and are not barred from the accessing or using the Platform or information on it under any applicable jurisdiction. The terms of use may be updated from time to time, to adapt to circumstances. IUCN NL cannot guarantee you will receive notice of change, so it is up to you to check the Terms of Service on this page from time to time.

Intended use and purpose

The Platform allows registered users and visitors to share information about nature conservation and/or poverty reduction, with the intention to improve the professionalism and quality of work of persons and organisations active to promote these topics. In participating on the Platform, through registration, creating a personal profile, uploading content, sending messages, or otherwise, you agree to provide constructive contributions towards this goal, and to provide true, accurate, current and complete information.

You agree to not use the Platform to:

1. upload, post, email, transmit or otherwise make available any Content that:
   1. is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
   2. you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learnt or disclosed as part of employment relationships or under nondisclosure agreements);
   3. infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
   4. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
   5. is unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
2. impersonate any person or entity, including, but not limited to forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
3. "stalk" or otherwise harass another; and/or collect or store personal data about other users in connection with the prohibited conduct and activities set forth in the paragraphs above.
4. disrupt the normal flow of dialogue, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
5. interfere with or disrupt the Platform or servers or networks connected to it, or disobey any requirements, procedures, policies or regulations of networks connected to the Platform, including using any device, software or routine to bypass our robot exclusion headers;
   
   

IUCN NL reserves the right to disable, remove or hide content or user profiles that are not in line with these rules, or when IUCN NL has reasonable grounds to suspect content or user profiles are not in line with these rules. IUCN NL also reserves the right to restrict or ban access to users who do not comply with these rules. IUCN NL may delegate the disabling, removal or hiding of content or blocking access to users to other parties involved in the operation of the Platform.

The Platform is an initiative of a network of organisations, and is operated by IUCN NL. IUCN NL or its partner organisations may send you messages, such as service announcements, administrative messages, or newsletters as part of your use of the Platform.

Personal data and privacy

To interact with the Platform as a registered user, you use a password to authenticate yourself. Your account is intended for personal use, and you are responsible for maintaining the confidentiality of the password and account. You are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify IUCN NL of any unauthorised use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.

You acknowledge, consent and agree that IUCN NL may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce the TOS; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of IUCN NL, its users and the public.

Information you make available on the Platform is intended for public use, and is linked to your personal account. Your email address will only be made available to registered users who are logged in on the Platform.

The Platform uses cookies to facilitate interaction on with the Platform. The servers also keep log files of activities on the site, to be aggregated in statistics that are not personally identifiable. The log files contain the IP address of your internet connection, which in principle could be used to trace back to the computer from which you are connecting to the site.

Ownership

The Platform is owned by IUCN NL. IUCN NL does not claim ownership over content that you contribute to the platform. However, when uploading or contributing content, you grant IUCN NL a worldwide, royalty-free and non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display the Content for the purpose of this Platform, either on the website or in other forms related to the website.

You are entirely responsible for the content you upload to the Platform (including forum contributions, documents, media, and any other data), whether this content is publicly or privately available on the Platform.

If you submit ideas, suggestions, documents, and/or proposals ("Contributions") for the further development of the Platform, you acknowledge and agree that:

1. your Contributions do not contain confidential or proprietary information;
2. IUCN NL is not under any obligation of confidentiality, express or implied, with respect to the Contributions;
3. IUCN NL shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide;
4. IUCN NL may have something similar to the Contributions already under consideration or in development;
5. your Contributions automatically become the property of IUCN NL without any obligation of IUCN NL to you; and
6. you are not entitled to any compensation or reimbursement of any kind from IUCN NL under any circumstances.
   
   

Liability and fitness for purpose

The Platform is provided "as-is", and IUCN NL assumes no responsibility for the timeliness, availability, deletion, failure, or accuracy of Platform or the information on it. Furthermore, your interaction with the Platform also depends on communication services of other parties (such as internet providers or equipment suppliers), for which IUCN NL cannot assume responsibility. You understand that you may be exposed to Content that is offensive, indecent or objectionable.

You agree to indemnify and hold IUCN NL and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit, modify or otherwise make available through the Platform, your use of the Platform, your connection to the Platform, your violation of the TOS, or your violation of any rights of another.

IUCN NL reserves the right to modify, disable, or discontinue parts of the services on the Platform, or the whole Platform, without prior notice.
